When It Becomes a Disciplinary Matter

Most events are coaching. A few are not, and handling those badly destroys both the case and the programme.

Where the line sits

Coaching: anything explicable, occasional, or attributable to route, vehicle or schedule.

Discipline: deliberate, repeated after coaching, or dangerous in a way that does not depend on interpretation.

Write the categories down in advance, because deciding under pressure after a serious clip produces inconsistency.

And state that a single event is coaching unless it meets a defined serious threshold, which protects both parties.

What makes a case hold

The event, with full context — the whole video buffer, not the trigger moment.

The system working demonstrably: thresholds appropriate, device calibrated, no known fault on that vehicle.

Evidence that coaching was offered first, for anything short of the serious threshold.

Consistency: has anyone else done this, and what happened to them?

All four. A case with one of them is the case that gets overturned.

What undermines one

A score used as the allegation. A score is a construction, not conduct, and a person cannot answer it.

Footage the driver has not seen.

Data from a system whose formula is proprietary, which cannot be explained to the person or to a tribunal.

And a threshold changed after the event, which is discovered in disclosure and ends the matter.

The process

The ordinary disciplinary sequence, with its steps followed.

Evidence shared in full, including the clip.

The driver's account taken seriously, including any explanation about the vehicle, the road or the schedule — which should be investigated rather than dismissed.

Investigation separate from decision, and a genuine appeal.

The serious threshold

Worth defining narrowly and in advance: phone use in motion on video, deliberate disabling of equipment, driving after declaring unfitness, speeds far beyond the limit.

Short list, unambiguous, published.

Everything else is coaching first.

The credibility cost

A programme introduced as safety and first used for dismissal will be understood as disciplinary from then on.

Which is a real cost: reporting stops, equipment gets obstructed, and the data degrades.

If a serious case arises early, say plainly why it met the threshold — that distinction is the only thing that preserves the framing.
