Where There Is Union Representation

This is the fleet system unions engage with most. What gets tested, and why a well-designed programme is easier rather than harder.

Driver monitoring attracts more representation involvement than any other operational system, and the questions asked are the ones a tribunal would ask.

What changes

Consultation may be a precondition rather than good practice, particularly for camera systems.

Collective agreements may specify what monitoring is permitted and how data may be used.

A right to be accompanied where any conversation becomes disciplinary.

And an organised route for disputes, which is frequently more effective than the one you built.

What gets tested

Whether the score can be explained. A proprietary formula fails this immediately.

Whether coaching is coaching or discipline in another form.

Consistency: who is coached, who is disciplined, and whether route type explains the pattern.

Whether the cab camera was justified specifically or because it was included.

Whether data is used for the purpose stated, which is the question that produces the most findings.

All five are things you should have settled anyway.

Why it helps

A representative who understands the system stops weak cases early, which saves the individual and the process.

Consultation produces thresholds that work, because the people who know the junctions are in the room.

And an agreement reached collectively is applied consistently, which removes the commonest ground of challenge.

The mistake to avoid

Treating representation as an obstacle.

It produces adversarial handling of matters that would have resolved in a conversation, and hardens exactly the behaviours the programme was meant to change.

And the questions asked early cost a meeting; asked late they cost a case.

Introducing a system

Consult before procurement, not after signature.

Share the threshold data and the false positive rate, which demonstrates the system is understood.

Agree what the data will and will not be used for, in writing.

And agree the serious threshold, so a disciplinary case is not the first time anyone discusses where the line is.

The position worth holding

A visible formula, a defined purpose, a dispute route and a separation between coaching and discipline.

Where those exist, representation tests them and finds them sound.

Where they do not, union involvement does not create the weakness. It finds it.

A representative asks whether the score can be explained, whether coaching is really discipline, and whether the purpose has held.

Which is precisely what a tribunal would ask.

Answering them early costs a meeting; answering them late costs a case — and the answers are ones you needed anyway.
